摘要：盗窃罪是司法实践中发案率比较高的罪，也是刑法理论中争议较大的罪。 本文着重讨论了单位盗窃和既遂标准问题，涉及使用盗窃等盗窃罪其它问题。对于单位有关人员组织实施的盗窃行为可以按个人盗窃处理。我认同“犯罪未得逞”就是指犯罪行为没有齐备具体犯罪构成的全部要件。在关于既遂与未遂的各种学说中，我赞同控制说；只有控制说才能同时满足盗窃罪既遂对主观和客观两方面的要求。对于使用盗窃问题应具体问题具体分析。
