自1994 年7月1日《中华人民共和国对外贸易法》实施生效以来，我国已初步建立了反倾销法律制度。该法第30 条明文规定了中国的反倾销规则，即“产品以低于正常价值的方式出口，并由此对国内已建成的相关产业，造成实质损害或者产生实质损害的威胁，或者对国内建立相关产业造成实质阻碍时，国家可以采取必要措施，消除或者减轻这种损害，或者损害的威胁或者阻碍。”其第32条规定：“当发生上述情况时，国务院规定了有关部门依法做出调查，并做出处理。”上述规定和关税与贸易总协定第6条规定几乎一样。1997年3月25日国务院颁布了《中华人民共和国反倾销和反补贴条例》。该条例将反倾销实体法和程序法集于一身，对于从申请、立案开始到终裁，征收反倾销税为止的每一个具体环节，均作了相应的规定，为我国的企业针对外国产品的倾销提起反倾销诉讼，提供了切实可行的法律依据。此外，国家经济贸易委员会还制定了《中华人民共和国国家经济贸易委员会产业损害裁定听证规则》，该规则是根据《中华人民共和国对外贸易法》和《中华人民共和国反倾销和反补贴条例》的有关规定，制定的适用于中华人民共和国国家经济贸易委员会在反倾销和反补贴程序中组织的产业损害裁定听证。它较全面、系统的规定了产业损害裁定听证的原则及当事人、听证主持人、回避以及听证程序等问题。③但这些法规与WTO的有关基本原则仍然有不尽符合之处，因此，2001年11月26日我国又颁布了新的一部法律《中华人民共和国反倾销条例》，废除了97 年《条例》中的有关反倾销的规定。该法律是参考国外发达国家和世界贸易组织比较完善的法律规定而出台的，较之以往，有了很大的进步。但其还有许多地方需要再商榷，以便更好的保护我国工业的发展。WTO的成立，尤其是1994 年的《反倾销协议》的签订，对世界各国的反倾销立法都起了推动作用。我国正处于经济转型期间，又才迈进WTO大门，如何运用WTO法和与WTO接轨直接关系到我国在日益激烈的国际贸易中的利益得失。同时，我国正承受着倾销和反倾销的严峻现状，这些都对我国反倾销立法的制定提出了新的要求。
