Excluded from the Confidential Information is information that the Receiving Party can prove by written evidence: (a) was in the public domain as of the Effective Date of this Purchase Order; (b) has entered the public domain, without the Receiving Party’s fault, after the Effective Date; (c) was in the Receiving Party’s possession as of the Effective Date; or, (d) has been acquired after the Effective Date from third parties that neither had previously acquired it directly or indirectly from the Disclosing Party nor were bound by any secrecy obligation
以下接受方能提供书面证明的信息被排除在保密信息之外：（a）订单生效期曾被公开；（b）订单生效期过后并非由于接受方的过错导致的信息公开；（c）订单生效期由接受方控制；或者（d）订单生效期过后，由第三方处获得信息，该第三方而之前从未直接或间接从披露方获得过此信息，该第三方也不曾受任何保密义务约束。
机密资料排除在信息接收方可以以书面证据证明:(一)在公共领域的有效日期,该订单; (B)已进入公共领域,不接受党的错误,生效后; (C)是在接受党所拥有的生效日期; 或者 (D)在已经取得的生效日期由第三者,无论是以前获得的直接或间接的约束,也没有泄露党的任何机密义务
