摘要：法的强制性问题历来为人们所瞩目，强制论者更是对其推崇备至，他们认为：强制是法律之所以为法律的标志、特征；法律实施的动力在于强制。易言之，强制是法律存在和法律实施的本质特征。这种观点对于强制性过于夸大，研究人类社会发展史，我们可以从中看出，法律在社会中所扮演的角色不应是杀气腾腾的暴力，而应该是通过无形的威慑力去维护社会的存续、个人的生存、保护个人的权利。但是，现在的社会条件下，人们无法达到自觉守法的境界，单靠人们的自觉是无法保障法律实施的，需要国家强制力来保证法律的顺利实施。因此，人类社会发展到今天，推崇法的强制性仍然是必要的。不可否认，法的强制性也存在它的弊端。
