Until recently, the COTOREP guided handicapped people towards the ordinary environment, with possible adaptations, or towards the sheltered environment. The latter consisted of sheltered workshops (18,264 people in 2000), home work distribution centres and employment assistance centres (CAT, 95,811 people in 2000). In the CAT, which are medical / social establishments, the people did not have the status of handicapped worker.
From now on, sheltered workshops will be referred to as adapted firms (art. 19) and will form part of the ordinary working environment. Like home work distribution centres, they will receive aid for each post. The salary received by their workers must not be lower than the minimum inter-professional growth wage. In the CAT, the only organisations within the sheltered environment, people will have the status of handicapped workers. 3,000 new CAT places were financed in 2003 and the same number will be financed in 2004.
The COTOREP also provided the disability rate, guided people towards specialized institutions and decided whether they fulfilled the criteria for the allocation of different benefits. Appeals could be made against these decisions before the disability tribunal under the supervision of the Supreme Court of Appeal.
From now on, "in order to provide a unique method for accessing rights and benefits (…) and all opportunities of support to access training and employment and guidance towards establishments and services as well as assisting handicapped persons and their families, in their procedures, a departmental organisation for handicapped people has been created in each department. The departmental organisation for handicapped people is responsible for welcoming, informing and advising handicapped people and their families" (art. 27 law 2004, art. L. 146-3 of the social action and families code).The activities of the different services and committees relating to handicapped people will be grouped together in this context. A committee supporting the rights and autonomy of handicapped people will be created within this organisation which will make decisions concerning all handicapped peoples’ rights, particularly in relation to the allocation of benefits and guidance (art. 29 law 2004, art. L. 146-5 and L.241-5s of the social action and families code). This committee will therefore assume the functions of the COTOREP.
